The 2007 Energy Conservation Construction Code of New York State is based on the 2003 International Energy Conservation Code. It addresses the design of energy-efficient building envelopes and the installation of energy-efficient mechanical, lighting, and power systems through requirements emphasizing performance. This comprehensive code establishes minimum regulations for energy-efficient buildings using prescriptive and performance-related provisions. It makes possible the use of new materials and innovative techniques that conserve energy.

The 2007 Energy Conversation Construction Code of New York State combines language from the 2003 International Energy Conservation Code, 2004 Supplement to the International Energy Conservation Code and New York modifications developed by the State Fire Prevention and Building Code Council and its Energy Code Technical Subcommittee. In addition, administrative modifications in Chapter 1 of the 2007 Energy Conservation Construction Code were developed by the Department of State's Administrative Task Group.

The 2007 Energy Conservation Construction Code of New York State applies to residential and commercial buildings, and to buildings regulated by the Residential Code of New York State.

The 2007 Energy Conservation Construction Code of New York State regulates the design and construction of buildings for the effective use of energy. It is intended to provide flexibility to permit the use of innovative approaches and techniques to achieve the effective use of energy. It is not intended to abridge safety, health or environmental requirements contained in other applicable codes, laws or regulations.

Note: When within the jurisdiction of the City of New York, Counties of New York, Kings, Queens, Bronx and Richmond, the following shall apply:
1. For determination of occupancy classification and use within this code, a comparable occupancy classification may be made to the Building Code of the City of New York.
2. Where reference is made within this code to codes referenced in the Uniform Fire Prevention and Building Code, the reference shall be deemed to be to the respective Building and Electrical Codes of the City of New York.
